Article 1 – Purpose

These Terms of Use are intended to stipulate the conditions of use and operational matters for the services of the "HSG Sungdong Shipbuilding Website" (hereinafter "the Site").

Article 2 – Definitions

Key terms used in these Terms are defined as follows.

  1. Member: A person who has agreed to the Site's terms, provided personal information, completed member registration, concluded a service agreement with the Site, and uses the Site.
  2. Service Agreement: A contract concluded between the Site and a member regarding the use of the Site.
  3. Member ID (hereinafter "ID"): A unique combination of letters and numbers assigned to each member for identification and service access.
  4. Password: A combination of letters and numbers chosen by the member to verify their identity as the owner of the assigned ID and to protect the member's rights.
  5. Operator: The person or entity that establishes and operates the website under this service.
  6. Termination: The act of a member canceling the service agreement.

Article 3 – Rules Supplementary to the Terms

The Operator may separately notify and announce operational policies as needed. Where there is a conflict between these Terms and the operational policies, the operational policies shall take precedence.

Article 4 – Formation of the Service Agreement

  1. The service agreement is formed when a person wishing to register as a member and use the Site agrees to these Terms and applies for membership, and the Operator approves such application.
  2. A person who wishes to register as a member and use the service shall express their consent to these Terms by reading these Terms at the time of membership application and selecting "I Agree" below.

Article 5 – Service Use Application

  1. Users who wish to register as members and use the Site must provide all information requested by the Site (User ID, password, nickname, etc.).
  2. Members who do not register their true information, such as by misappropriating another person's information or registering false information, may not assert any rights in connection with the use of the Site and may be subject to penalties under applicable laws.

Article 6 – Privacy Policy

The Site and the Operator do not retain passwords provided during membership registration; such matters are governed by the Site's Privacy Policy.

The Operator endeavors to protect members' personal information, including member registration information, in accordance with applicable laws and regulations.

The protection of members' personal information is governed by applicable laws and the Privacy Policy established by the Site.

However, the Operator bears no responsibility for information exposed due to reasons attributable to the member.

If a member registers or distributes unlawful content, such as posts that undermine public morals or violate national security, the Operator may, upon request from the relevant authorities, access and submit the member's data to such authorities.

Article 7 – Obligations of the Operator

  1. If the Operator recognizes that opinions or complaints raised by members are legitimate, the Operator shall process them as promptly as possible. However, if prompt handling is difficult due to personal circumstances, the Operator shall make best efforts to notify members afterward via notices, messages, emails, or other means.
  2. To ensure continuous and stable provision of the Site, the Operator may request the Site to repair or restore any equipment failures or losses without delay. However, in the event of a natural disaster or unavoidable circumstances for the Site or the Operator, the Site's operation may be temporarily suspended.

Article 8 – Obligations of Members

  1. Members must comply with the provisions of these Terms, all regulations established by the Operator, notices, operational policies announced by the Site, and applicable laws, and must not engage in any conduct that interferes with the Site's operations or damages the Site's reputation.
  2. Members may not transfer, donate, or provide as collateral their right to use the service or any other status under the service agreement without the explicit consent of the Site.
  3. Users must exercise due care in managing their ID and password and may not provide their ID to third parties for use without the consent of the Operator or the Site.
  4. Members must not infringe upon the intellectual property rights of the Operator, the Site, or any third party.

Article 9 – Service Hours

  1. Service hours are in principle available 24 hours a day, 365 days a year, unless there are special operational or technical impediments. However, the Site may temporarily suspend service on dates or times designated by the Site for regular system inspections, expansions, or replacements. Service interruptions due to scheduled maintenance will be announced in advance on the Site's homepage; please check periodically.
  2. However, the Site may temporarily or permanently suspend the service without prior notice or warning in the following cases:
    • Emergency system inspection, expansion, replacement, failure, or malfunction
    • Force majeure events such as national emergencies, power outages, or natural disasters
    • Suspension of telecommunications services by a carrier regulated under the Telecommunications Business Act
    • Disruption to normal service due to excessive traffic or similar circumstances
  3. In the event of a service suspension under the preceding paragraph, the Site shall notify members in advance through notices or other means. However, if advance notice is not possible due to reasons beyond the Site's control, a subsequent notice shall be provided instead.

Article 10 – Termination of Service Use

  1. If a member wishes to terminate their service agreement with the Site, the member must submit a termination request online. Please note that termination of the service agreement with the Site must be processed separately from termination of Site access.
  2. Upon submission of a termination request, the Site-related programs provided by the Site are automatically deleted from the member management screen, and the Operator will no longer be able to view the information of the person requesting termination.

Article 11 – Restrictions on Service Use

Members must not engage in any of the following acts. If a member engages in such acts, the Site may restrict the member's use of the service, take appropriate legal action, terminate the service agreement, or suspend the service for a designated period.

  1. Registering false information at the time of membership registration or when updating information
  2. Interfering with another person's use of the Site or misappropriating another's information
  3. Impersonating the Site's operators, employees, or affiliates
  4. Infringing upon the personal rights or intellectual property rights of the Site or any third party, or interfering with their operations
  5. Unauthorized use of another member's ID
  6. Collecting, storing, or disclosing another member's personal information without consent
  7. Acts objectively determined to be associated with criminal activity
  8. Any other conduct in violation of applicable laws and regulations

Article 12 – Management of Posts

  1. The Operator is responsible for managing and operating the posts and materials on the Site. The Operator must continuously monitor for inappropriate posts and materials, and upon discovering or receiving a report of such content, must delete the relevant post or material and issue a warning to the member who registered it. Members are personally responsible for the posts they upload and must not post any content that violates these Terms of Use.
  2. If a public institution such as the Korea Communications Standards Commission requests corrective action, the Operator may delete or move posts without the member's prior consent.
  3. The criteria for determining inappropriate posts are as follows:
    • Content that severely insults or damages the reputation of another member or third party
    • Distributing or linking content that violates public order or social morals
    • Content that facilitates illegal copying or hacking
    • Advertising for commercial purposes
    • Content objectively recognized as associated with criminal activity
    • Content that infringes upon copyright or other rights of another user or third party
    • Content otherwise determined to violate applicable laws and regulations
  4. If the Site or Operator receives a request from a third party to suspend a post on grounds of defamation, infringement of intellectual property rights, or other rights violations, the Site may temporarily suspend (block transmission of) such post. If a lawsuit, settlement, or equivalent decision by a relevant authority between the requester and the post registrant is filed with the Site, the Site shall comply accordingly.

Article 13 – Preservation of Posts

If the Site Operator is compelled to shut down this Site due to unavoidable circumstances, the Operator will provide advance notice to members and endeavor to take all necessary measures to facilitate the transfer of posts.

Article 14 – Copyright in Posts

  1. Copyright in posts uploaded by members to the Site belongs to the member who posted them. The Site may not use such posts for commercial purposes without the poster's consent. However, this does not apply to non-commercial purposes, and the Site holds the right to display such posts within the service.
  2. Members may not use materials posted on the service for commercial purposes, including arbitrarily processing or selling information obtained through the service.
  3. If the Operator determines that content posted or registered by a member falls under any of the categories in Article 12, the Operator may delete, move, or refuse to register such content without prior notice.

Article 15 – Liability for Damages

  1. Primary civil and criminal liability arising from activities on this Site rests with the member.
  2. No compensation shall be provided for damages suffered by members from this Site if such damages are caused by force majeure events such as natural disasters, or by the member's own intention or negligence.

Article 16 – Disclaimer

  1. The Operator is exempt from liability for damages arising from a member's failure to obtain expected benefits from the Site's services, or from the member's selection or use of service materials.
  2. The Operator is exempt from liability for service disruptions caused by failures in this Site's infrastructure or telecommunications services provided by other carriers; damages arising from this Site's service infrastructure are governed by the Site's Terms of Use.
  3. The Operator bears no responsibility in relation to materials stored, posted, or transmitted by members.
  4. The Operator shall not be liable for disruptions to service use caused by reasons attributable to the member.
  5. The Operator shall not be liable for any activities between members, between members and third parties, or any other activities of members whether inside or outside this service (including data transmission and other community activities).
  6. The Operator shall not be liable for the authenticity, reliability, accuracy, or other aspects of materials posted or transmitted by members or any materials available to members through this Site.
  7. The Operator shall not be liable for any damages arising from transactions of goods or other dealings conducted between members or between a member and a third party through the service.
  8. The Operator shall not be liable for any disputes arising between members or between members and third parties for reasons not attributable to the Operator.
  9. The Operator shall not be liable for damages to members caused by system failures occurring without intentional or grossly negligent conduct during the management, inspection, maintenance, or replacement of servers or other equipment, or during software operations; system failures resulting from third-party attacks; the spread of computer viruses for which no countermeasures have been developed by recognized domestic or international research institutions or security firms; or other force majeure events beyond the Operator's control.

Supplementary Provision

These Terms shall take effect from the date of the Site's establishment.
